  • General Information

    1. Classification - 8th edition — single class application. Class 33, alcoholic goods in class 32, and pork meat in class 29 cannot be registered
    2. Search - Possible for word and device marks
    3. Examination - Formality, absolute, and relative grounds
    4. Opposition period - 90 days from publication date
    5. Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions
    6. Term of protection - 10 years from filing date and renewable for like periods
    7. Use – Mark is vulnerable to cancellation action by interested parties if there is no bona fide use of the mark for a period of 5 consecutive years preceding the date of filing for cancellation

     

  • Filing Requirements

    • Power of Attorney, duly legalized by the Yemeni Consulate.
    • Extract from the entry of the applicant in the Commercial Register, or any equivalent document, duly legalized by the Yemeni Consulate.

  • Renewal

    • Power of attorney legalized by the Yemeni Consulate.
    • Photocopy of the registration certificate.

  • Assignment

    • Power of attorney signed by the assignee, legalized by the Yemeni Consulate.
    • Deed of assignment document legalized by the Yemeni Consulate.
    • Certified copy of the certificate of incorporation or an extract from the commercial register of the assignee with it Arabic or English translation.
    • Copy of the registration certificate or the last renewal certificate.

  • Change of name/address

    • Power of attorney under the new name or address, legalized by the Yemeni Consulate.
    • Certificate of incorporation or extract from the commercial register reflecting the change of name or address, legalized by the Yemeni Consulate with Arabic or English translation.
    • Copy of the registration certificate or the last renewal certificate.

  • =License

    • Power of attorney signed by the licensee, legalized by the Yemeni Consulate.
    • License agreement document with Arabic or English translation, legalized by the Yemeni Consulate.
    • Copy of the registration certificate or the last renewal certificate.

  • General Information

    1. Search – Both pending and granted patents can be searched by title, patentee name or priority data
    2. Examination – Formality only
    3. Publication - Published in the Official Gazette upon allowance
    4. Opposition period - 90 days from publication
    5. Annuities - Paid annually on the anniversary of the filing date, currently there is no additional charge for late payment of maintenance fees.
    6. Term of protection - 20 years from the filing date

    • Deed of Assignment from the inventor(s), duly legalized by the Yemeni Consulate or a copy of the original Assignment as filed with the basic foreign application, duly legalized by the Yemeni Consulate.
    • An Extract from the Commercial Register or Articles of Association or Incorporation, if the applicant is a corporate body, duly legalized by the Yemeni Consulate.
    • In case of claiming priority, a certified copy of the corresponding home application dulylegalizedby theYemeniConsulate.

    • Deed of assignment document legalized by the Yemeni Consulate.

  • Change of name/address

    • Power of attorney under the new name or address, legalized by the Yemeni Consulate.
    • Certificate of incorporation or extract from the commercial register reflecting the change of name or address, legalized by the Yemeni Consulate with Arabic or English translation. License

  • License

    • Power of attorney signed by the licensee, legalized by the Yemeni Consulate.
    • License agreement document with Arabic or English translation, legalized by the Yemeni Consulate.

  • Merger

    • Power of attorney legalized by the Yemeni Consulate.
